(ARA) ? Even in a volatile economy, homeowners are making home upkeep a priority. While the number of projects annually had been on the decline in recent years, a study from BuildFax, a resource for building, remodeling and repair information, found remodeling activity was up in 2011 over 2010. ?Now is the right time to make efficiency improvements around the home because homeowners will see an immediate impact on their monthly utility bills, and will reap even greater benefits in the long term,? says Frank O?Brien-Bernini, chief sustainability officer at Owens Corning. ?According to the U.S. Department of Energy, buildings use more energy in the United States than either transportation or industry, accounting for the consumption of 40 percent of our nation?s energy resources. In many homes, excessive energy is wasted through poorly sealed and insulated attics, walls and ductwork ? all problems that can be solved by handy do-it-yourselfers or through experienced contractors.?
The Home Improvement Research Institute reports roughly one in three homeowners plans to purchase more energy-efficient doors, windows or HVAC systems in the coming year. Sealing all openings around doors and windows can help homeowners make the most of their investment. Air ducts should also be inspected to ensure they are clean, are free of leaks and holes and direct air to the right spaces.
Recycling 101
While recycled content is commonly focused on, recyclable materials are also important. Often with home improvement projects, old materials are thrown out and replaced with the new. What many homeowners may not know is that many building materials and appliances are recyclable. Recycling is a better solution for the environment, and may be less costly than taking material to a landfill.
?There are more recyclable materials on and in a home than you might first assume. Millions of tons of shingles torn off from roofs end up in our country?s landfills each year. Fortunately, the technology now exists for all those shingles to be recycled instead,? says O?Brien-Bernini. ?In 2009, Owens Corning Roofing and Asphalt, LLC formed an alliance with Heritage Environmental Services to create a Shingle Recycling Program with roofing contractors to make recycling convenient, cost-competitive and differentiating and have since recycled more than 90,000 tons of asphalt shingles.?

Updating your Facebook status from your work computer ? even if it violates your company's policy ? isn't a federal crime, according to a ruling by a San Francisco federal appeals court.?
Sure it sounds extreme that such a question was even pondered by a federal court. ?But Facebooking and similar computer-based goldbricking could've been considered a violation of the the Computer Fraud and Abuse Act (CFAA) if the San Francisco's Ninth Circuit didn't dismiss "charges that would have criminalized any employee's use of a company's computers in violation of corporate policy," notes the Electronic Frontier Foundation:
In (U.S. v. Nosal), the government prosecuted an ex-employee of an executive recruiting firm on the theory that he induced current company employees to use their legitimate credentials to access a proprietary database and provide him with information in violation of corporate computer-use policy. The government claimed that the violation of policy constituted a violation of the CFAA, a law with criminal penalties.
While the case isn't specifically focused on Facebook, the ruling is another example of how the government is increasingly sucked into the conflict between how we earn a living and how we use the world's largest social network.?Earlier this week, Maryland became the first state to pass a bill prohibiting employers from demanding employee user names and passwords to Facebook and other social networks. In March, two U.S. senators asked federal agencies to look into whether employers and colleges that are asking for access to individual Facebook profiles are breaking the law.??
In?U.S. v. Nosal, accessing Facebook through work computers ? if against company policy ? could've been deemed a federal crime as well.?
In its role as a digital rights advocate, EFF filed an amicus brief ? an opinion volunteered by a party not involved in a legal case. In it, EFF argued that "turning mere violations of company policies into computer crimes could potentially create a massive expansion of the law ? making millions of law-abiding workers criminals for innocent activities like sending a personal email or checking sports scores from a work computer, and leaving them vulnerable to prosecution at the government's whim."?
In its full opinion, the court agreed:?
Many employers have adopted policies prohibiting the use of work computers for nonbusiness purposes. Does an employee who violates such a policy commit a federal crime? How about someone who violates the terms of service of a social networking website? This depends on how broadly we read the Computer Fraud and Abuse Act.
The court's findings overturn last year's ruling by a previous court which found that employees who violate their employer's computer policy could be accused of breaking the CFAA. The new opinion points out that broad interpretation of the CFAA could criminialize typical human behavior:?
Minds have wandered since the beginning of time and the computer gives employees new ways to procrastinate, by gchatting with friends, playing games, shopping or watching sports highlights. Such activities are routinely prohibited by many computer-use policies, although employees are seldom disciplined for occasional use of work computers for personal purposes. Nevertheless, under the broad interpretation of the CFAA, such minor dalliances would become federal crimes. While it?s unlikely that you?ll be prosecuted for watching Reason.TV on your work computer, you could be. Employers wanting to rid themselves of troublesome employees without following proper procedures could threaten to report them to the FBI unless they quit. Ubiquitous, seldom-prosecuted crimes invite arbitrary and discriminatory enforcement.
"EFF has been fighting these aggressive government hacking arguments for years," EFF Staff Attorney Hanni Fakhoury said in a statement. "We're happy to see the court recognize that the government overreached here, and it issued a thoughtful decision that protects the rights of users."

WASHINGTON (AP) ? After an entire century that included two high-profile government investigations and countless books and movies, we're still debating what really caused the Titanic to hit an iceberg and sink on that crystal-clear chilly night.
Maybe there's more to blame than human folly and hubris. Maybe we can fault freak atmospheric conditions that caused a mirage or an even rarer astronomical event that sent icebergs into shipping lanes. Those are two of the newer theories being proposed by a Titanic author and a team of astronomers.
But the effort to find natural causes that could have contributed to the sinking may also be a quest for an excuse ? anything to avoid gazing critically into a mirror, say disaster experts and Titanic historians.
New theories and research are important "but at its most basic what happened is they failed to heed warnings and they hit the iceberg because they were going too fast," said James Delgado, director of maritime heritage at the National Oceanic and Atmospheric Administration.
With this week's 100th anniversary of Titanic's sinking, the interest in all things Titanic is steaming faster than the doomed cruise ship on its maiden voyage.
One of the novel new theories says Titanic could have been the victim of a mirage that is similar to what people see in the desert. It's the brainchild of Tim Maltin, a historian who has written three books about Titanic. The latest, an e-book titled "A Very Deceiving Night" emphasizes how the atmosphere may have tricked the Titanic crew on a cloudless night.
"This was not avoidable human error," Maltin said in a telephone interview from London. "It's just about air density difference."
It was a beautiful clear night and for a couple of days, there had been something strange going on in the air over the North Atlantic, reported by all sorts of ships, including the crew on Titanic, Maltin said.
The unusually cold sea air caused light to bend abnormally downward, Maltin said. The Titanic's first officer, William McMaster Murdoch, saw what he described as a "haze on the horizon, and that iceberg came right out of the haze," Maltin said, quoting from the surviving second officer's testimony.
Other ships, including those rescuing survivors, reported similar strange visuals and had trouble navigating around the icebergs, he said.
British meteorologists later monitored the site for those freaky thermal inversions and said 60 percent of the time they checked, the inversions were present, Maltin said.
The same inversions could have made the Titanic's rescue rockets appear lower in the sky, giving a rescue ship the impression that the Titanic was smaller and farther away, Maltin said.
Physicists Donald Olson and Russell Doescher at Texas State University have another theory in Sky &Telescope magazine that fits nicely with Maltin's. Olson ? who often comes up with astronomical quirks linked to historical events ? said that a few months earlier, the moon, sun and Earth lined up in a way that added extra pull on Earth's tides. The Earth was closer to the moon than it had been in 1,400 years.
They based their work on historical and astronomical records and research in 1978 by a federal expert in tides.
The unusual tides caused glaciers to calve icebergs off Greenland. Those southbound icebergs got stuck near Labrador and Newfoundland but then slowly moved south again, floating into the shipping currents just in time to greet the Titanic, the astronomers theorized. Maltin said the icebergs also added a snaking river of super-cold water that magnified the mirage effect.
Tides and mirages may have happened, but blaming them for Titanic's sinking "misses the boat," said Lee Clarke, a Rutgers University disaster expert and author of the book "Worst Cases."
"The basic facts of Titanic are not in dispute: The boat was going too fast in dangerous waters," Clarke said. If Titanic had stopped for the night because of ice like the British steamship Californian did, "tides and mirages wouldn't have mattered."
On April 14, the day it hit the iceberg, the Titanic received seven heavy ice warnings, including one from the Californian less than an hour before the fateful collision. The message said: "We are stopped and surrounded by ice." Titanic sent back a message that said "Shut up. We are busy."
Clarke said people keep looking for additional causes "because if it's nature or God, then we're off the hook, morally and practically."
Yale disaster expert Charles Perrow said he found the mirage theory plausible, especially because cold air played visual tricks that were a factor in a 1979 airplane crash in Antarctica that was originally blamed on pilot error.
Steven Biel, who wrote "Down with the Old Canoe: A Cultural History of the Titanic Disaster," said he understands the search for other reasons.
"There's something appealing about retrospectively gaining control over an event that's centrally about uncertainty and contingency and lack of control," he said.

Remember the public pressure on the Komen Foundation that led the organization to change a board decision? I said back then this was a harbinger of a new expression for public accountability that foundations need to understand. It is an early edge of a new kind of governance capacity for which most foundations (and most nonprofits) are not prepared. If you think it's about a social media strategy, you're wrong.
The Gates Foundation is experiencing this right now. The Foundation provided grant funds to the American Legislative Exchange Council (ALEC). ALEC works on many policy issues. In the wake of the killing of Trayvon Martin ALEC's support for "stand your ground" laws has drawn outrage and calls for boycotts from many directions, including from a group called the The Progressive Change Campaign Committee (PCCC). The Gates Foundation has said it will continue to meet its current grant obligations to ALEC (which run over another 17 months) but won't make further grants.
Put aside what you think of Komen, Gates, ALEC, or PCCC for a moment. This is not about any of these organizations per se. It is about public pressure, organized and otherwise, on nonprofits and foundations, about their decision making. It is about making decisions that will be challenged, and striking the right balance between legitimate board governance and respecting people's right to agree or disagree with you.
The kind of organizing that led Komen to change its decision and that is now calling for change from Gates to change is easier than ever. It can be turned on in an instant and reach unprecedented scale at unprecedented pace. Boards of directors of nonprofits and foundations need to know this, they need to expect it, and they need to engage with both critics and supporters. They need, in other words, to govern in a new landscape in which each and every decision they make may be the one that transforms supporters into critics (see Komen) or turns educational policy grants into part of national outrage about gun laws and racial justice (see ALEC).
Is this about a social media policy? I don't think so. Is it about governance, engagement, conversation, accountability, structural consistency, clarity of mission, and a willingness to remain civil while participating in difficult areas of work riven with disagreement? Yes. Nonprofits are part of civil society which thrives only when it is filled with multiple points of view and diverse approaches to problem solving. The "public" will not agree with every decision a foundation or nonprofit makes and they have a right to express that disagreement. Foundations and nonprofits have a right (and a responsibility) to make their decisions and expect a public response to them.
What we need civil society organizations to do is discuss, civilly, their points of view, their decisions, and their goals. And to structure themselves to be able to do so. This requires thinking about the constitution and skills of their staffs, boards, and advisors, the way they provide access to their key decision makers, and the ways they engage with critics and supporters in the real context in which those things will happen, not in some nostalgic early 20th century institutionally-bound model.
Business has already learned that there is simply too much information for one organization to hold it all. As Bill Joy has said, "the smartest people are always going to work for someone else." The MIT Media Lab has an interesting chart to show the relationship between information and organizations.The point of these ideas is to encourage businesses to build networks that will be better able to manage information and generate new ideas. But the power of networks and permeable organizations applies not just to generating new ideas. In the case of nonprofits and foundations, generating ideas with the public, communicating ideas and theories and strategies with the public, and civilly debating with the public - especially the public that disagrees with you - is going to be a critical attribute in the future. See this article (pp 14- 15) from Darin McKeever of Gates Foundation on "embracing the scrutiny of the crowds."
This may involve new kinds of constituent representation on boards. It could involve an ongoing advisory board role or meaningful, regular discussion of issues with stakeholders. There are many forms and tactics that institutions can try to be more conversational.? But first, they need to recognize that the days of "broadcast" and "isolation" are over and structure themselves accordingly. What is at stake is not individual grant decisions, but public trust in and the legitimacy of these organizations as a whole.

Lowering glucose levels for people with diabetes is normally critical to improving health outcomes. But for those with heart failure, that might not always be the case, say UCLA researchers.
A new study found that for advanced heart failure patients with diabetes, having higher blood glucose levels may actually help improve survival rates.
Currently published online in the American Journal of Cardiology, UCLA researchers compared levels of a marker used to track glucose levels called glycosylated hemoglobin in advanced heart failure patients with and without diabetes. The marker is gauged through a simple blood test.
The study assessed the relationship between levels of the marker and mortality outcomes. Researchers found that for heart failure patients with diabetes, for every unit increase in the marker, there was a 15 percent decrease in mortality.?
"We were surprised that the optimal level of glycosylated hemoglobin in this patient population with diabetes was higher than levels in current treatment guidelines,? said senior author Dr. Tamara Horwich, assistant professor of cardiology, David Geffen School of Medicine at UCLA. ?We may find that doctors who treat patients who have both advanced heart failure and diabetes may not need to focus on aggressively lowering blood sugar, but rather keep it under moderate control.?
Approximately 25 to 50 percent of patients with heart failure also have diabetes, compared to just 7 percent of the general population. The relation could be due to similar physiologic processes that underlie both conditions such as oxidative stress, patterns of hormonal activity and vascular lining dysfunction that can lead to conditions like Atherosclerosis.
For the study, researchers assessed medical records of 845 patients with advanced heart failure, referred to a single university center, the Ahmanson-UCLA Cardiomyopathy Center. Most of the patients (72 percent) were men and the average age was 55.
Patients were classified as having diabetes or not and also grouped by four levels of glycosylated hemoglobin. Using statistical analysis, researchers calculated risk of death or need for an urgent heart transplant.
?For heart failure patients with diabetes, we found that higher, not lower levels, of the marker had better outcomes,? said first author Sofia Tomova, a medical student in the division of cardiology, Geffen School of Medicine.
Researchers found that for diabetic heart failure patients, two-year event-free survival was highest amongst patients with the highest elevated glycosylated hemoglobin levels: 65 percent survival rate for patients with level four (greater than 8.6 percent of the marker) and 61 percent survival rate with level three (7.3 to 8.5 percent of the marker).
Patients with lower levels of the marker had worse survival rates: 48 percent survival rate for patients with level one (less than 6.4 percent of the marker) and 42 percent survival rate with level two (6.5 to 7.2 percent of the marker).
According to researchers, the ideal level of glycosylated hemoglobin in heart failure patients with diabetes appeared to be in the 8.3 to 8.9 percent range. Current national treatment targets aim much lower at 7 percent.
In the heart failure patients without diabetes, there was no significant mortality risk difference between the glycosylated hemoglobin levels.
Researchers note that for those without heart failure, having diabetes and elevated glycosylated hemoglobin levels is a risk factor for developing the condition. However, the study shows that if a patient already has heart failure, having higher glycosylated hemoglobin levels may be protective.
The next steps are studies to test the optimal glucose management goals as well as assess the best anti-diabetic medications for heart failure patients with diabetes.
Heart failure affects six million in the United States alone and is caused by weakened heart muscle function that can cause build-up of fluid in the lungs and other organs due to the heart?s inability to pump effectively.

Boston, MA Meningioma, the most common primary brain tumor in the United States, accounts for about 33 percent of all primary brain tumors. The most consistently identified environmental risk factor for meningioma is exposure to ionizing radiation. In the largest study of its kind, researchers from Brigham and Women's Hospital (BWH), Yale University School of Medicine, Duke University, UCSF and Baylor College of Medicine have found a correlation between past frequent dental x-rays, which are the most common source of exposure to ionizing radiation in the U.S, and an increased risk of developing meningioma. These findings are published in the April 10, 2012 issue of Cancer.
"The findings suggest that dental x-rays obtained in the past at increased frequently and at a young age, may be associated with increased risk of developing this common type of brain tumor," said Elizabeth Claus, MD, PhD, a neurosurgeon at BWH and Yale University School of Medicine at New Haven. "This research suggests that although dental x-rays are an important tool in maintaining good oral health, efforts to moderate exposure to this form of imaging may be of benefit to some patients."
Claus and her colleagues studied data from 1,433 patients diagnosed with meningioma between 20 and 79 years of age between May 2006 and April 2011 and compared the information to a control group of 1350 participants with similar characteristics. They found that patients with meningioma were twice as likely to report having a specific type of dental x-ray called a bitewing exam, and that those who reported having them yearly or more frequently were 1.4 to 1.9 times as likely to develop a meningioma when compared to the control group. Additionally, researchers report that there was an even greater increased risk of meningioma in patients who reported having a panorex x-ray exam. Those who reported having this exam taken under the age of 10, were 4.9 times more likely to develop a meningioma compared to controls. Those who reported having the exam yearly or more frequently than once a year were nearly 3 times as likely to develop meningioma when compared to the control group.
"It is important to note that the dental x-rays performed today use a much lower dose of radiation than in the past," said Claus.
According to background information in the study, The American Dental Association's statement on the use of dental radiographs emphasizes the need for dentists to examine the risks and benefits of dental x-rays and confirms that there is little evidence to support the use of dental x-rays in healthy patients at preset intervals.

Late last week, one Justin Watt discovered something suspicious going on with the wi-fi at his hotel, the Times Square Marriott. Not content to charge him hundreds for the room and $16.95 for internet access, it appeared that the service provider was using JavaScript injection to serve banner ads on every website guests visited. Internet service providers are always coming up with new packages for private and?business?customers. Internet service providers?in?my area have a number of?cost-effective communications?solutions?through a variety of?broadband?packages.
Businesses need fast connection?to?the internet, especially large ones that communicate and work?in-house through a LAN, or local area network. This allows employees?to communicate and share files with one another. Considering that time is money, they need?to?have the ability for instant?communication.?This is important because?companies?often need?to?access?business-related emails, maintain websites, respond?to?orders from customers, communicate with employees at other locations and maintain contact with suppliers.

With dedicated internet access,?broadband?provides the instantaneous?communication?that?companies?require through an Ethernet connection. Ethernet is lightning fast and allows for increased productivity when multitasking with multiple devices. It is especially useful for offices that have a large number of employees. With all this?in?mind, it is obvious that for most?companies, the days of cross-country and international flights are over. That makes?broadband?cost-effective?for any?businessthat has?to?train employees or meet with customers and suppliers. Additionally, it saves money by saving time for office employees who must access, download or upload information quickly. Many good internet service providers?in?my area offer excellent?broadband?packages for?business?customers and most of them offer introductory pricing offers.

Transgressive may mean:
Journalism was not listed in these descriptions of trangressive practices, probably because journalism was originally taught and centered on reporting the facts. ? The female student editor of the University of Missouri student newspaper, The Maneater, wrote a "trangressive" journalistic piece for April Fools Day that wasn't appreciated by many readers.? She used terminology offending certain groups and like the word "teabaggers", she used a word which insinuated sexual practices.? From the editor's mea culpa letter:Although many parts of this edition were vulgar and offensive, I want to first take the time to explain the masthead. I truly did not know that ?carpet eater? is a derogatory term used for a lesbian. Had I known, I would never have even considered using it. I chose the masthead because I thought the pairing of the play on words of ?The Maneater? with the sexual innuendo of that term could be funny. I realized there was a sexual connotation in this term, but I did not realize it was derogatory toward the LGBTQ community. Not knowing is not an excuse, however, and I?m sure that if I had brought this to every member of the 24-person editorial board, and made sure that every single person had read it, someone would have known this was a slur. Unfortunately, I did not do this, and my ignorance has harmed other people. I could not be more sorry about this. I?d also like to note that the negative connotation that masthead carries does not reflect the opinion of the editorial board.?
Other derogatory words toward women were also printed in this edition, such as ?cunt,? ?slut? and ?whore.? This was a massive oversight on our part. I allowed these to be printed because my thinking was that, as they were used in a satirical way and mostly as plays on words, the context in which they were used did not speak to women and the treatment of women. My poorly thought out rationale, which I realize now was wrong and potentially dangerous, was that since they were not used in a way that glorifies the mistreatment or objectification of women, they were not offensive. I realize now that these words in and of themselves can contribute to further prejudice, no matter the context. In addition to offending people on a personal level, the April Fool?s issue could detract from the work campus organizations and individuals have done to create a more inclusive campus. These words communicate beliefs that neither The Maneater editorial board nor I believe. Language and context is a false dichotomy, and the language in this edition was not at all acceptable.?
I can't locate a copy of the original April Fools piece but there are several sites reporting on the Maneater publishing a questionable article.? The reader comments from letters to The Maneater's editor are quite interesting.Jill said:
How many times are we expected to accept apologies from this newspaper? This is at least the third egregiously offensive Maneater publishing that's taken place this semester. (The first two being "Grindr lovin', had me aghast" by Emma Woodhouse, and 'Jane Eyre: Prude 'n' proud" by Claire Landsbaum.) As an MU student I cannot stress enough how sick and tired I am of hearing about what the Maneater's done now. Do you realize that every offensive, insensitive, disgusting thing you print negatively affects the image of our entire university? And our journalism school? The fact that this apology needs to be written is offensive to me. Not because I was displeased by any article in the April Fool's edition, but because no one seems to have a sense of humor or skin thicker than tissue paper. The offense that people have taken to this issue is more disgusting to me than every profanity, slur, vulgarity in the English language. Since I am so outrageously offended by other people's offense, I demand the immediate apology from everyone who claimed to be harmed, because overly-sensitive, self-righteous, sanctimonious umbrage is repulsive to me. Oh wait, that's not how things work. If you're offended by words used purely for humor's sake then your offense is completely manufactured and corresponds to nothing in the real world. Words are not inherently offensive; they are only hateful when they are intended to demean or degrade another person. As anyone with an I.Q. above 14 would be able to tell you, the April Fool's edition clearly did not use the terms maliciously, so any hurt feelings are purely the result of someone looking to be offended. If you think the word choice was childish, immature, or otherwise below the journalistic standards that the Maneater ought to adhere to, then you'll find no argument from me. If you're upset because you think the word "cunt" is always, in every circumstance, in any context whatsoever, unacceptable, then you are incalculably more immature and unprofessional and pathetic than anything contained in the April Fool's edition of the Maneater. Grow up. If you're legally an adult, you should start behaving like one.

It is sad that the people supposed to have the most knowledge of the world and it's culture can be so socially unaware of this.
