Excess Casualty Rates Continue to Rise

Excess casualty insurance rates continued to rise in the third quarter of 2012, as insurers sought higher prices amid increasing claims and litigation trends, and a low interest rate environment, insurance broker Marsh said in a report.

Renewal rates rose on average by 3 percent in the third quarter, marking the fifth straight quarter of price increases, according to Marsh?s latest Marsh Risk Management Research Briefing, Benchmarking Trends: Excess/Umbrella Insurance Rates Still Increasing.

Companies with recent significant losses typically saw the highest increases in pricing and primary attachment points, often times in conjunction with coverage restrictions. Overall, 46 percent of Marsh?s clients received a rate increase in the third quarter, 39 percent saw no change, and 15 percent saw rates decline. This mirrors what clients experienced in the first two quarters of 2012.

?Given the continued increase in claim trends along with deteriorating combined ratios, underwriters are seeking to raise rates on umbrella and excess insurance across all industries,? said Tony Tam, Marsh?s U.S. Excess Casualty leader. ?However, robust competition and ample capacity in the market is tempering much of those efforts.?

For the remainder of 2012, excess/umbrella insurers likely will continue to seek mid- to high-single digit rate increases, on average, for expiring program structures, Marsh said. Companies with difficult risk profiles are likely to experience increases of 10 percent or greater.

?For organizations renewing their casualty insurance programs in this environment, regular communication with underwriters and exploration of alternative structures is key,? Tam said. ?Those insureds that start the renewal process early and differentiate themselves to underwriters?with particular focus on core and non-core exposures?will be best positioned to secure favorable terms at renewal.?

Hadley Named USA Track & Field Athlete of the Week

INDIANAPOLIS - Fifteen-year-old Alana Hadley has been named USA Track & Field?s Athlete of the Week after winning the Queens Royals Challenge 5 km Friday at the McAlpine Greenway Park in Charlotte, N.C.

The high school sophomore bested a field of 217 runners, nearly all of them collegiate athletes. Teams competing in the meet included Florida State, Duke, Davidson and Elon. Hadley led the race from the 800-meter mark and never looked back as she won in a time of 17:16.74.

?I could hear people behind me, and I focused on staying ahead of them,? Hadley said. ?I didn?t want anyone to pass me, and it helped me out in the end because I was constantly pushing because I didn?t know how much of a lead I had.?

Hadley is coached by her father, and she hopes to one day be a professional marathon runner.

?When I found out about the award I was ecstatic,? Hadley said of being named Athlete of the Week. ?When I found out that it was Dathan Ritzenhein last week, I was so surprised that it went from this elite runner to a high school sophomore.?

Now in its 11th year, USATF?s Athlete of the Week program is designed to recognize outstanding performers at all levels of the sport. USATF names a new honoree each week and features the athlete on www.usatf.org. Selections are based on top performances and results from the previous week.

New Study Shows HPV Shot Doesn't Encourage Sexual Activity in Girls 0 5

Preteen girls who received the human papillomavirus (HPV) vaccine were no more likely than unvaccinated girls to get pregnant, develop sexually transmitted diseases (STDs), or seek birth-control counseling.

These were the findings of a new study, discounting concern that HPV vaccination encourages promiscuity, reported USA Today.

HPV is the leading cause of cervical cancer. NY Daily News said the HPV vaccine can help prevent cervical cancer, but it's most effective when given to girls before they become sexually active.

CBS News stated that the Centers for Disease Control and Prevention and the American Academy of Pediatrics recommend HPV vaccination for preteen girls and boys at age 11 or 12. Three doses are generally recommended over six months.

But less than half of girls eligible receive it, wrote MSN.com. Reuters said that one of the arguments against HPV vaccination is that it gives preteens a false sense of security when it comes to sex.

The new study seems to supports evidence to the contrary. The study involved girls enrolled in an Atlanta Kaiser Permanente health plan.

Reuters wrote that out of 1,398 girls who were 11 or 12 when they saw their doctors in 2006 and 2007, 493 got at least one dose of the HPV vaccine.

CBS News said that the researchers didn't ask girls about having sex. Instead they looked at sexual activity ?markers? after vaccination against the sexually transmitted human papillomavirus.

Specifically, they examined up to three years of records whether girls sought birth control counseling; tests for STDs or pregnancy; or became pregnant.

Very few of the preteen girls who got the shots had done any of those over the next three years, wrote Associated Press. Moreover, the study found no difference in rates of those markers compared with unvaccinated girls.

Based on primary care visit records, 107 of the girls were given a pregnancy test through 2010, and 55 were tested for chlamydia. Girls who did or didn't get the HPV vaccine were equally likely to be tested for both, said Reuters.

Are social media users looking for alternatives to Facebook?

Mary-Kathryn Vest enjoys keeping up with her friends and family on Facebook, but logging on to Facebook and seeing public bickering between her family members leaves her annoyed and frustrated. However, Vest has found a new social media outlet with significantly less turmoil.

?I?d choose Pinterest over Facebook in a heartbeat. With Facebook there?s an overwhelming amount of drama and things to keep up with. Pinterest has none of that; it?s just fun,? said Vest.

She is not alone. Pinterest is just one of the many alternative venues to Facebook. Social media users are now flocking to other sites such as Tumblr, Instagram, and Pinterest to communicate and share. What do all of these have in common? They are focused on pictures. This increasing popularity of photo-rich sites could detract usage from Facebook, which has been the longstanding ?king? of social media, with over 900 million users.

Willie Baronet, advertising professor at Southern Methodist University, said one of Facebook?s main flaws is that it can cause conflict among groups of people.

?It can cause some insulation among groups who only hear people with similar opinions repeating the same thoughts over and over,? said Baronet.

While all of these sites are centered on photo content, each one brings something different to the table.

With an estimated 73.2 million users, Tumblr is a micro-blogging platform as well as a social media site. It is different from Instagram and Pinterest in presentation. Everything appears in a blog format, and users post their own content and re-blog from other users.

Instagram has around 15 million users and is a free photo-sharing platform where users can take photos, apply a filter or effect, and then share it with the Instagram community. It is a fast way to create lasting memories on the Web while sharing with others.

In contrast, Pinterest is an online pin board styled site for sharing photos. ?Pinners? may create different themed boards and ?re-pin? other pinners? photos in order to express their own taste.

Taylor Suzanne is a food blogger, but said she found her new passion is Pinterest.

?Pinterest is a vessel to help the creatively challenged! It provides a creative outlet, allowing me to think outside the box,? said Suzanne.

Suzanne is currently obsessed with holiday decorating ideas, but on a regular basis, she uses Pinterest to get ideas and recipes for her food blog.

Tumblr?s format tends to be less organized, however Pinterest users are able to create as many boards as they wish under countless categories.

?I could spend my whole day on Pinterest. It?s such a great way to organize ideas and things that intrigue or inspire me,? said Vest.

Vest is an aspiring wedding photographer, and likes to view photography and wedding boards on Pinterest for inspiration.

Because Pinterest and Instagram can link to Facebook, if the user so chooses, SMU student Travis Carlile believes these digital-sharing sites only strengthen Facebook.

?I don?t think that Facebook has lost its popularity, it?s just that the whole horizon has just been spread out more,? said Carlile.

Carlile believes each new social media is focusing on a part of Facebook, but that users will continue to use Facebook because it provides a central location for statuses, check-ins, and photos.

Baronet believes as the popularity of photo-sharing social media apps and sites increases, some wonder if the photo quality online will be reduced. Baronet says this is possible.

?I do think the pervasiveness of social media does shift people?s expectations about what ?acceptable photography? can be,? said Baronet.

Baronet also said photo-sharing sites affect bloggers.

?I?ve been blogging since 2005, and it?s definitely caused me to blog less. I think that would be the impact for many bloggers,? said Baronet.

As with all advancements in technology, these multi-media sites will create a change in the way people communicate and share knowledge and ideas in the years to come.

Baronet said new multimedia sites would provide, ?Greater connection, less privacy, more tolerance, more transparency from those with privilege/power hopefully, quicker access to news, and continued ways to enhance how we connect to one another.?

Farrakhan chides Obama, rips GOP and Romney in Charlotte

Speaking in Charlotte on Sunday, Louis Farrakhan had this advice for President Barack Obama:

Fight.

?Mr. President, you?ve got to realize you?re fighting for your presidential life,? the leader of the Nation of Islam told an estimated gathering of 6,000 at Bojangles? Coliseum. ?You?re fighting for your vision of the Democratic Party and the country.?

In marking the 17th anniversary of his 1995 Million Man March on Washington, D.C., Farrakhan was scheduled to talk about the economy and a Muslim ?blueprint for ending need and want.?

But with the Nov. 6 election three weeks away, the 79-year-old Muslim leader changed his mind, instead offering advice to the president and country, describing a United States still ruptured by race.

Then Farrakhan spent two hours hammering at racial ? some critics will call them racist ? themes.

To begin, the highly controversial Farrakhan accused Republicans of having ?overt? racist motives in their opposition to Obama, the country?s first black president. He attacked a political process that he says is controlled by monied interests and wants ?to keep America white.?

And while he claimed Obama?s Republican opponent, Mitt Romney, had lied about his real positions on most major issues throughout the first presidential debate, he also criticized Obama?s low-energy response.

He asked his listeners if they were disappointed in Obama?s performance, and hundreds of hands rose throughout the coliseum.

?Feels like your champion didn?t show up for the fight,? Farrakhan said. ?If you lose the first round or two, you go to your corner. It?s called ?adjustment time.? Every good fighter knows how to make an adjustment. You don?t get lost.?

He said he thinks Obama and his advisers worried about the president appearing like ?an angry black man.? The reasoning: ?You can?t go out there and beat up on a white man. You?re going to lose the white vote.?

He then turned his comments back to the president.

?You aren?t going to win any more white votes by being kind and gracious,? he said. ?Be a little black.?

Farrakhan?s injection of race into the presidential campaign comes as both parties trade accusations, direct and implied, of racist intent. Obama received 95 percent of the black vote in 2008, and more than 2?million blacks voted for the first time.

Some Democrats say Republican-led voter ID campaigns in several key states are aimed at holding down the black vote. Some conservatives say support for Obama by many African-American voters starts and ends with color. They say they oppose the president on philosophical, not racial, grounds.

Ron Christie, a black conservative who worked for President George W. Bush, told the Huffington Post that black people support Obama out of ?a straitjacket solidarity.?

Farrakhan did nothing to dissuade that support, accusing the Republicans of using a strategy to defeat Obama ?so overtly hateful and racist in nature that it has polarized America on the basis of race.?

The Nation of Islam minister has made a career out of such harsh rhetoric. He has been accused of fueling racial dissent, anti-Semitism and homophobia. He denied the accusations Sunday, saying he speaks truth as he sees it.

Testimonial to Pat Randolph

Since I know that not all Property Profs also subscribe to the DIRT listserv (although you should), I wanted to share that fellow Property Prof and founder of DIRT, Professor Patrick Randolph of University of Missouri at Kansas City, passed away on October 12th.? Pat Randolph has had an enormous impact on property professors and real estate lawyers across the country for decades.?

Although I did not know Pat Randolph well, I've seen him at least once a year, usually twice a year, at meetings of the American Bar Association Real Property, Trust and Estate Law Section.? He was always warm, funny, and kind to me.? As his constant presence at ABA meetings demonstrates, Pat worked hard to create and maintain connections between academia and the practicing bar.? The DIRT listserv is one example of those efforts.? He will be missed.

Here's a little more detail about Pat's contributions to the academy and practice, courtesy of his friend and colleague, Professor Roger Bernhardt of Golden Gate University:

It is not easy to adequately describe Pat's enormous contributions to legal education, real estate law and the legal community. Dirt arose as an offshoot of the ABA's Quarterly Development Report, which Pat assembled and provided to us for years, and it was the best way I knew of keeping up with developments outside my turf.? Later, when Pat got Dirt underway, it was the Daily Developments' fully briefed and thoughtfully analyzed cases that he provided for us almost every day of the year - that quickly became our bread and butter source of information.? I cannot estimate how much discipline and how many hours that Pat had to donate to keep Dirt vibrant for so many years.

Pat also sat on the Executive Committee of the Real Property Probate & Trust Section of the ABA, founded a Legal Education Section there, and pried loose a Real Estate Transactions Section out of the AALS Property Section. He was at the same time going around the country giving his "Top Ten" talks to numerous bar groups, as well as being an entertaining speaker at frequent panels for the ABA, ACMA, ACREL, and PLI.? On top of all that Pat wrote Friedman on Leases and played a pioneering role in starting a real estate legal system in China, constantly going back and forth there and accommodating their students in his house in Kansas City) and writing books and journals on it.

What I particularly valued most of Pat's many activities was his effort to bridge the gap between law school academics and the practicing real estate bar. Before Pat, property professors wanted nothing to do with real estate practice, and lawyers typically couldn't even remember the name of who taught the course to them in law school.? ?? Pat got the two groups interacting with each other, for which I am truly grateful.

New US visa rush: Build charter school, get green card

It's been a turbulent period for charter schools in the United States, with financial analysts raising concerns about their stability and regulators in several states shutting down schools for poor performance.

The volatility has made it tough for startup schools to get financing.

But an unlikely source of new capital has emerged to fill the gap: foreign investors.

Wealthy individuals from as far away as China, Nigeria, Russia and Australia are spending tens of millions of dollars to build classrooms, libraries, basketball courts and science labs for American charter schools.

In New York, foreign funds paid for the Health Sciences Charter School in Buffalo to renovate a 19th-century orphanage into modern classrooms and computer labs. In Arizona, overseas investment is expected to finance a sixth campus for the booming chain of American Leadership Academy charter schools.

And in Florida, state business development officials say foreign investment in charter schools is poised to triple next year, to $90 million.

The reason? Under a federal program known as EB-5, wealthy foreigners can in effect buy U.S. immigration visas for themselves and their families by investing at least $500,000 in certain development projects. In the past two decades, much of the investment has gone into commercial real-estate projects, like luxury hotels, ski resorts and even gas stations.

Lately, however, enterprising brokers have seen a golden opportunity to match cash-starved charter schools with cash-flush foreigners in investment deals that benefit both.

"The demand is massive - on the school side," said Greg Wing, an investment advisor. "On the investor side, it's massive, too."

Two years ago, Wing set up a venture called the Education Fund of America specifically to connect international investors with charter schools. He is currently arranging EB-5 funding for 11 schools across North Carolina, Utah and Arizona and says he has four more deals in the works.

And that's just the start, Wing says: "It's going to be explosive."

Credit crunch
The charter school movement is somewhat controversial. Critics - led by teachers' unions - contend they divert much-needed funds from traditional public schools. Still, they have proved quite popular and now educate more than 2 million children in the United States.

Charter schools are publicly funded but privately run, sometimes by for-profit companies. They receive taxpayer dollars to educate each child who enrolls. Yet in most states, they get little or no public money to build classrooms, libraries and other facilities.

Well-established and successful chains of charter schools, such as KIPP, Green Dot or Achievement First, receive hefty support from philanthropic foundations and private donors. The chains can also tap into financing provided by an array of for-profit and non-profit investment funds created for that purpose.

But the charter school movement also includes hundreds of small, one-of-a-kind schools, often started by parents seeking a different educational environment for their children. Those mom-and-pop startups have always had a hard time securing funding to build their schools. Many have had to make do with makeshift classrooms in strip malls or church basements.

And lately, experts say, the credit crunch has worsened.

"It's a hard go," said Eric Hall, an attorney in Colorado Springs who advises charter school boards.

Last month, Fitch Ratings warned it was likely to downgrade bonds backed by charter schools because the sector is volatile and the schools are highly leveraged. Such risks mean charter-school debt is typically considered speculative, rather than investment grade, said Eric Kim, a director at Fitch Ratings.

Meanwhile, the IRS has signaled it plans closer scrutiny of charter schools' tax-exempt status if they rely on for-profit management companies to provide their classroom space and run their academic programs, Hall said. He sent his clients a long memo this summer warning that the stepped-up IRS oversight could put some at "significant risk."

If that weren't enough to make investors wary, several well-known charter schools have run into significant legal and fiscal hurdles in recent months.

Missouri regulators shut down six campuses run by Imagine Schools, one of the nation's largest for-profit charter chains, because of poor academic performance. A judge in California ruled that Aspire Public Schools, a large non-profit chain, hadn't secured the proper approval for six of its schools and would have to get permission from local boards of education to continue running them. Local officials yanked the charter of a high-achieving middle school in Georgia over concerns about mismanagement.

All told, about 15 percent of the 6,700 charter schools that have been launched in the United States in the past two decades have since closed, primarily because of financial troubles, according to the Center for Education Reform, which supports charter schools.

This fall alone, more than 150 established charter schools didn't open their doors to students.

Such volatility "will spook people, no doubt about it," said David Brain, chief executive officer of Entertainment Properties Trust, which has historically owned movie theaters but branched out to invest in charter schools, including the six that were shuttered in St. Louis.

Brain said the closures did not affect his company's bottom line and he remains convinced charter schools are a profitable sector. But even he's not ready to start backing untested startup schools.

Charter school administrators say they know that wariness all too well.

"Until you get that charter renewal that says you're doing good things" - typically after five years in operation - "banks won't even talk to you," said Hank Stopinski, principal of the Health Sciences Charter School in Buffalo. Without foreign investment, he said, "we would not have been able to do this project."

Recession-proof
The EB-5 program has drawn sharp criticism in the past. Some immigrant investors have lost both their money and their shot at U.S. citizenship when their American partners proved inept or corrupt. In the United States, critics have questioned the value of trading visas for scattershot investment.

Yet interest is surging. In the first nine months of this year, the government approved 3,000 petitions from foreigners seeking to participate in the program - nearly twice as many as were approved all last year, according to the Department of Homeland Security.

Charter schools have become particularly trendy because they are pitched as recession-proof.

An investor forum in China last spring, for instance, touted U.S. charter schools as a nearly fool-proof investment because they can count on a steady stream of government funding to stay afloat, according to a transcript posted on a Chinese website.

Arizona educator Holly Johnson, who runs three charter schools and plans to open a fourth next year, said she couldn't believe how easy it was to secure $4.5 million in funding from abroad.

"We didn't have to do anything at all," she said, other than open her schools to potential investors. They didn't ask many questions, she said. Their concern was more basic: "They wanted to come over and make sure it was real."

Inner satisfaction
Eager to join the rush, Ali Faisal devoted a day this week to touring charter schools in Arizona.

Faisal, 37, is a Pakistani citizen who now lives in Calgary, Canada. He runs a technology consulting business that works with oil and gas companies and says he is eager to expand to the United States. He figures the best way to do that is to get a green card.

And the best way to do that, he said, is the EB-5 program.

Participants can get a temporary visa by investing $500,000 to $1 million in a federally approved business. If the business creates or preserves at least 10 jobs in two years, the investor and his immediate family are eligible for permanent residency in the United States.

"It's a much easier path," Faisal said.

He decided to put his money in a charter school, he said, because that way he felt he'd be serving society as well as helping himself. The schools he saw impressed him with their rigorous science curriculum and he said he hoped his investment would help nurture a new generation of American entrepreneurs.

"Investing in some type of hotel," Faisal said, "will not give me that inner satisfaction."

Wall Street climbs as jobless claims hit four and a half year low

NEW YORK (Reuters) - U.S. stocks advanced on Thursday after data showed initial jobless claims fell to the lowest level in more than four and a half years, suggesting improvement in a key factor for economic growth.

The number of Americans filing new claims for unemployment benefits dropped by 30,000 to a seasonally adjusted 339,000, according to Labor Department data. Economists polled by Reuters had forecast claims edging up to 370,0000 last week.

The report follows last week's government report that showed a surprising drop in September's unemployment rate to 7.8 percent.

"Claims looked pretty strong, definitely a big drop down. We're starting to hear noise about companies hiring, and that's what the market is waiting for," said Jordan Waxman, managing director Hightower Advisors in New York.

"Without labor market improvement, we can't get a sustainable rally. The numbers seem to be moving in the right direction."

Stock futures were also supported by a note from Citigroup, which upgraded U.S. equities to "overweight," citing cheap equity valuations and aggressive central bank actions to stimulate the economy.

The benchmark S&P 500 index had shed 2 percent over the prior four sessions, its biggest four-day drop since late July, amid concern about the impact of slowing world growth on corporate profits.

Weak global demand has heightened investor worry over the corporate earnings season. As a group, S&P 500 companies' third-quarter earnings are expected to fall 2.9 percent from a year ago, according to Thomson Reuters data for the first decline in three years.

The S&P 500 rose 2.4 percent in September but has dropped 0.6 percent thus far in October as investors' focus has shifted to stock fundamentals.

Other data showed the U.S. trade deficit widened in August to $44.2 billion. U.S. exports fell for a fifth consecutive month and imports declined slightly, hinting at weaker U.S. and global demand.

The Dow Jones industrial average <.dji> gained 42.92 points, or 0.32 percent, to 13,387.89. The Standard & Poor's 500 Index <.spx> gained 8.09 points, or 0.56 percent, to 1,440.65. The Nasdaq Composite Index <.ixic> gained 19.25 points, or 0.63 percent, to 3,071.03.

Sprint Nextel Corp shares jumped 13.5 percent to $5.72 as the best performer on the S&P 500 after a source familiar with the matter told Reuters Softbank Corp , Japan's third-largest mobile carrier, is in talks to acquire a majority stake in the No. 3 wireless carrier in the United States.

Clearwire Corp , in which Sprint holds a majority interest, surged 27.3 percent to $1.65. MetroPCS shares dropped 8.4 percent to $11.03 as a Softbank deal would rule out Sprint making a counter-bid for the company which recently agreed to be acquired by Deutsche Telekom AG .

Fastenal Co climbed 8.3 percent to $45.82 after the company posted third-quarter earnings.

Winnebago Industries Inc reported a higher quarterly profit and strong growth in its order backlog as demand for its motor homes grew. Shares gained 2.9 percent to $12.55.

Feds: Look Out for Faulty Counterfeit Airbags

Today, the National Highway Traffic Safety Administration (NHTSA) issued a consumer safety advisory on malfunctioning counterfeit airbags. The NHTSA suspects that in the past three years, bags that look identical to the real thing but don't work properly may have been installed in nearly 0.1 percent of all U.S. vehicles (which works out to about 250,000 cars). So far no deaths have been linked to the bags, but federal testing has found them to consistently fail to deploy or even explode in a burst of shrapnel.

The feds think the fraudulent bags probably found their way into consumer vehicles by way of independent repair shops and online stores. In August, for example, police arrested a mechanic in North Carolina on suspicion of trafficking counterfeit airbags. Police said they found 1500 of them at the man's home, plus 100 more at the garage where he worked.

"Organized criminals are selling dangerous counterfeit and substandard airbags to consumers and suppliers with little to no regard to hazardous health and safety consequences," U.S. Immigration and Customs Enforcement Director John Morton said in an agency press release. "We will continue to aggressively investigate criminal supply chains with our law enforcement and private industry partners and bring these criminals to justice."

NHTSA advises that only vehicles that have had their airbags replaced by third-party repair shops within the past three years are at risk. If you suspect your car may have had a counterfeit bag installed, you can contact your manufacturer?s call center and have your vehicle inspected free of charge. A full list of manufacturer call centers and vehicles at risk is available at www.safercar.gov.

Report: PCs bound for 1st sales decline since 2001

SAN FRANCISCO (AP) ? A new report predicts worldwide sales of personal computers are bound for their first annual decline in 11 years.

The forecast issued Wednesday by the research firm IHS iSuppli projects that nearly 349 million PCs will be shipped this year. That would be a 1 percent decrease from nearly 353 million PC shipments last year.

Although small, the anticipated decline would be the first time that annual PC sales haven't grown since 2001.

PC makers began the year with hope that a new wave of lightweight laptops called ultrabooks would provide a sales lift. But the ultrabooks haven't been compelling enough to overcome the growing popularity of smartphones and tablet computers. Those mobile devices are reducing the need for consumers and businesses to buy new PCs or replace older ones.

As the year winds down, the PC industry is now counting on an upcoming makeover of the Windows operating system to revive interest in desktop and laptop machines.

Windows 8 has been redesigned by Microsoft Corp. so it can power hybrid PCs that can be controlled by touching a display screen or relying on a keyboard and computer mouse. The revamped operating system also works on tablet computers, including one that is being made by Microsoft. If the tablets running on Windows catch on, they threaten to siphon even more sales from PCs.

Machines running on Windows 8 are scheduled to go on sale Oct. 26 from Lenovo Group Ltd., Hewlett-Packard Co., Samsung Electronics Co., Dell Inc. and others.

Evidence tossed at start of papal butler's trial

VATICAN CITY (AP) ? The pope's once-trusted butler went on trial Saturday for allegedly stealing papal documents and passing them off to a journalist in the worst security breach of the Vatican's recent history ? a case that embarrassed the Vatican and may shed further light on the discreet, internal workings of the papal household.

In its first hearing in the case, the three-judge Vatican tribunal threw out some evidence gathered during the investigation of butler Paolo Gabriele, who is charged with aggravated theft. It also decided to separate Gabriele's trial from that of his co-defendant, a computer expert charged with aiding and abetting the crime.

Gabriele is accused of taking the pope's correspondences, photocopying the documents and handing them to Italian journalist Gianluigi Nuzzi, whose book "His Holiness: The secret papers of Pope Benedict XVI," was published to great fanfare in May.

Prosecutors have said Gabriele confessed to taking the documents because he wanted to expose the "evil and corruption" in the church. They quoted him as saying during an interrogation that he felt inspired by the Holy Spirit to inform the pope about the church's problems and that a "shock, even a media one, would have been healthy to bring the church back on the right track."

Nuzzi on Saturday wished Gabriele well, tweeting "Good Luck, courageous Paoletto, we're with you." He referred to Gabriele by the diminutive nickname used by the pope and other members of the papal household.

The trial inside the intimate, austere courtroom was the highest-profile case to come before the Vatican judiciary since the 1929 founding of the Vatican city state, the world's smallest sovereign state. Media from around the world converged on St. Peter's Square to cover the case, which has attracted attention not so much because of the content of the documents but because they were stolen from the pope's desk and leaked, allegedly by one of Benedict's closest assistants.

On Saturday, the court said the pope's personal secretary, Monsignor Georg Gaenswein, had been called as a witness, testimony that is sure to attract attention given that Gaenswein rarely speaks in public much less about the details of the tight-knit papal family of which Gabriele formed part.

Other witnesses include one of the four consecrated women who take care of the pope's apartment, a monsignor in the Vatican secretary of state, the No. 2 Swiss Guard commander and the head of the Vatican police force.

Judge Giuseppe Dalla Torre set the next hearing for Tuesday, when Gabriele will be questioned. He said he thought the whole trial could be wrapped up in four more hearings.

Gabriele faces up to four years in prison if he is convicted. He has already asked to be pardoned by the pope, something most Vatican watchers say is a given.

Gabriele, 46, appeared calm but tense during the 2 hour, 15 minute hearing, frequently crossing his hands or clasping them in his lap. He wore a light gray suit and tie.

He sat alone on a bench on one side of the courtroom, following the proceedings impassively. During a break in the hearing, he chatted with his attorney, Cristiana Arru, and greeted journalists with a nod and a smile as he entered and exited.

Arru raised a series of objections at the start of the hearing, only some of which were accepted by the court. One concerned two jailhouse conversations Gabriele had with the head of the Vatican police force without his lawyers present. The judges declared both inadmissible. The content isn't public.

Arru also sought access to the report of a commission of cardinals appointed by the pope to investigate the leaks alongside Vatican magistrates. The court denied the request.

The attorney for co-defendant Claudio Sciarpelletti successfully petitioned to have his client's trial separated from that of Gabriele. Sciarpelletti wasn't in the court Saturday and his trial date wasn't set.

Neither Gabriele's wife nor any of his three children attended the hearing. Space for the public was limited; eight of the 18 seats were taken up by the journalists who followed the proceedings and then briefed the rest of the Vatican press corps afterward.

The courtroom itself was spare, with wood paneling along the walls, a gilded crest of the Holy See in the ceiling, a photograph of Benedict over the prosecutor's chair and a crucifix over the chair of the presiding judge. It's located in a four-story palazzo tucked behind St. Peter's Basilica in the Vatican gardens.

Security was relaxed, with the guards at the tribunal entrance mostly concerned that none of the press or public brought in any recording devices: They even checked pens to make sure they couldn't record, and sequestered cell phones into safe boxes. No television or still cameras were allowed, except for Vatican media which filmed the first moments at the start of the hearing.

Given the content of the leaks and the Vatican's penchant for secrecy, the fact that the trial was open to the public and media might seem unusual. In fact, such trials in the Vatican's civil and penal tribunal are routinely public. They just don't happen very often or attract much attention. The Vatican's ecclesial courts on the other hand, which handle marriage annulments, clerical sex abuse cases and other matters of church law, remain firmly off-limits to outsiders.

In some ways, the willingness of the Vatican to proceed with the trial at all is an indication of its efforts to show new transparency in its inner workings. Benedict could have pardoned Gabriele as soon as he was arrested or charged, precluding any trial from getting off the ground. Instead he allowed the trial to go ahead, evidence of the "courage" the Vatican is showing to be more transparent, Vatican spokesman the Rev. Federico Lombardi has said.

He called such transparency unprecedented for the Vatican and likened it to the Holy See's recent decision to submit its financial institutions to outside scrutiny by the Council of Europe's Moneyval committee.

Final Fantasy for iOS vs. Final Fantasy for NES: Retro gaming shoot-out!

Back in the day, the NES and the Super NES were THE consoles with THE the best role-playing game (RPG) titles, and Squaresoft (now Square Enix) was THE best of the best. Square's most renowned franchise, the Final Fantasy series, debuted on the NES in 1987 in Japan. That original Final Fantasy game was later released iOS in 2010. Or so they would have us believe. How does the iOS version of Final Fantasy stack up against the NES version of yesteryear? Was it moved over pixel for pixel, bit for bit? Was it improved to take advantage of modern hardware? Was it ruined by a process with no respect for the original? For the honor and virtue of retro gaming fans and RPG players everywhere, we decided to have a look.

Final Fantasy for iOS vs Final Fantasy for NES: Graphics and sound

To be honest, I was expecting a simple port to iOS, but I was happily proven wrong the moment the title screen lit up. I could see and hear the differences immediately. They are both Final Fantasy, yet the experience is better realized on the iOS, which has much improved audio and graphics. Now the venerable NES didn?t have the processing power of today's iOS devices, however, Final Fantasy on iOS doesn?t exactly use the full potential of the iPhone or iPod touch either. What it does use, however, it uses well. For example, I nearly confused Final Fantasy 1 on iOS for Final Fantasy 3 on the Super NES due to the mode 7-like overworld feature they added. Final Fantasy 3 was one of the most beautiful games to grace the Super NES, so I'm actually grateful for these types of the improvements here.

Final Fantasy for iOS vs Final Fantasy for NES: Gameplay mechanics

The graphics and sound weren?t the only things improved. The actually story line has been fleshed out with more (and more interesting) dialogue and explanations. The menu screens are improved with better access to each character, a vast improvement on the tedious process of pressing the action and back button to access various characters in game. Purchasing items is made easier as you can now see who in your party can use an item or spell, and who will have an improved status with easy to visualized green up and red down arrows.

The fight scenes now have the useful option of ?defending? as opposed to only fighting. When in a town or dungeon, you can now hold the d-pad and press the action button and your character will move more quickly -- an option not available in the original.

The best part, however, the part that truly gives the iOS version a huge edge over the NES version, is the improvements to the save game system. Previously, you could only save at an Inn, and when powering off the NES, you had to hold the reset button before pressing the power button off. Now, staying at an inn only restores your HP and MP. You can save anywhere at any time with 3 save slots. On top of that, there is a resume game option. So, when coming back to play the game, you can continue playing from the last time you closed the app.

Final Fantasy for iOS vs Final Fantasy for NES: Controls

One minor gripe I have with the new version on iOS is, of course, the lack of a physical control. I find myself not properly pressing on the virtual, on-screen d-pad at times and frustration can set in if I do this often enough. The NES gamepad never had that problem. You could feel you were properly pressing its buttons.

Final Fantasy for iOS vs Final Fantasy for NES: The bottom line

All in all, the improvements made are completely worth any retro gamer replaying this legend of an RPG on iOS device. And if you've never played Final Fantasy, go get it now. You're in for a treat.

Note: Square Enix hasn't seen fit to release an iPad version, or iPad optimized interface for the original Final Fantasy game on iOS. I play the iPhone/iPod touch version on my iPad in 2x mode, however, and it looks gorgeous.
