So we'll be at Facebook HQ on Thursday morning to find out about its "New home in Mobile." I've seen countless headlines (mostly rewrites of what probably are controlled leaks) full of possible answers about what we'll see on Thursday morning.

We'll be there, of course, to check it out. Liveblogs are inevitable, but Facebook should be streaming it live, if history repeats.

I don't have answers. But I do have a few questions. Will they be answered on Thursday? Or will we leave California once again asking "Why, Facebook? Why?"

Twas always so, going back to the Spartan ground on the University of Houston campus in a very rough part of town.

Everyone around MLS knows that Houston is among the toughest places ever in MLS to go get points. Dominic Kinnear?s team may not always be the most technically proficient ? although he has a very skillful bunch at the moment, especially in midfield ? but the team?s hallmark competiveness has always driven the Dynamo effort.

Throw in the narrow field that fits so well with the Dynamo way, and Kinnear?s team can always teach the MLS field about how to make things tough at your home ground.

Now, it?s official.

The Dynamo?s 2-0 win over San Jose matched a league record; Houston has gone 34 consecutive matches across all competitions without a loss. That matches Real Salt Lake?s record unbeaten streak at home, one that Jason Kreis? teams built from 2009-2011.

Saturday?s match at BBVA Compass Stadium, where the Dynamo are yet to lose, was notable for one other reason:

Burke leads UM rally over Kansas, 87-85 in OT

ARLINGTON, Texas (AP) ? Trey Burke never doubted he could lead Michigan to its deepest NCAA tournament run since the Fab Five era.

Not after a scoreless first half. Not when the Wolverines trailed top-seeded Kansas by 14 with less than 7 minutes left ? or by 5 with 21 seconds left.

And definitely not when he got the ball in his hands and the seconds draining away.

Burke scored all 23 of his points in the second half and overtime, including a long, tying 3-pointer in the final moments of regulation as Michigan rallied to beat Kansas 87-85 in the South Regional semifinals Friday night.

"We never lost faith out there," Burke said. "We stuck it out together."

Ben McLemore had 20 points to lead the Jayhawks (31-6), who looked to be on their way to a third straight regional final before Michigan's improbable rally. Instead, they became the third No. 1 seed to fall in this tournament, joining Gonzaga and Indiana.

"Well, this will certainly go down as one of the toughest games that obviously we've been a part of and I've been a part of," Kansas coach Bill Self said. "But props to Michigan for making all the plays late."

That's for sure.

The fourth-seeded Wolverines (29-7) were down five when Tim Hardaway Jr. missed a 3-pointer with 35 seconds left, but Glenn Robinson III won a scramble for the ball and hit a reverse layup to force Kansas to win the game at the free throw line.

The Jayhawks couldn't do it. Burke's tying shot ? he pulled up from well beyond the arc just left of the key ? came with 4.2 seconds left after Elijah Johnson missed a free throw and Michigan got the rebound.

Moments earlier, with 21 seconds remaining, Johnson had hit two from the line to keep the Kansas lead at five. Burke had scored on a layup to get Michigan back to within three.

"We never had the mindset that we were going to lose the game," Burke said. "When we were down 14, we knew anything could still happen. It's March, anything can happen."

Michigan went to back-to-back championship games a generation ago with the Fab Five led by Chris Webber, Juwan Howard and Jalen Rose. But the folks in Ann Arbor will be talking for years about the shot by Burke under the huge video board Cowboys Stadium, just down the road from where Howard and Rose played their last game together with Ray Jackson and Jimmy King in a regional final loss to Arkansas in 1994.

The Wolverines will play Florida in the regional final Sunday. The third-seeded Gators beat 15th-seeded Florida Gulf Coast 62-50.

"Just to be able to get this program back to the Elite Eight, it feels good," Burke said. "But we want to go further."

The lead changed hands five times in overtime ? the first OT game of the tournament ? the last when Mitch McGary, who led Michigan with 25 points and 14 rebounds, hit a short jumper with Johnson in his face to put Michigan ahead 83-82.

The Jayhawks got a stop and had about 9 seconds to tie or win, but a jumbled possession ended with Naadir Tharpe missing a running jumper at the buzzer.

"We played like we were trying to hold onto something instead of just continuing to play," Johnson said.

Burke had eight points in the closing 14-4 run that tied the game, then gave Michigan its first lead since early with another long 3-pointer to make it 79-78 early in overtime. He hit a jumper on the next possession as well. After failing to score in the first 20 minutes, Burke ended his drought by scoring eight straight points early in the second half to momentarily cut the deficit to two.

"In the second half, coach told me to be more aggressive so I looked for my shot more," he said.

But Kansas restored a 10-point lead built on controlling the paint, this time with a 3-pointer and a tomahawk dunk on a breakaway by McLemore and a three-point play from Johnson.

Johnson, who picked up three fouls in just three minutes of playing time in the first half, gave Kansas its biggest lead at 68-54 with a 3-pointer from the corner with just under 7 minutes left.

Travis Releford had 16 points for the Jayhawks, while Jeff Withey had 12 points and eight rebounds.

McLemore didn't score again after going to the bench with his fourth foul with 8 minutes remaining.

"We had chance to seal the game, but we made some bonehead plays late," Releford said.

Kansas pushed out to a 10-point lead early by dominating around the basket. McLemore's first basket was the first outside the paint as the Jayhawks scored 34 of their 40 first-half points from inside while shooting 69 percent.

Withey put Kansas ahead 29-19 with a turnaround shot that had McGary shrugging at a teammate and saying, "I'm trying."

McGary wasn't having nearly as much trouble on the offensive end, leading the Wolverines with 11 points and five rebounds in the first half. He picked up where he left off in the third round against Virginia Commonwealth, when he had season highs of 21 points and 14 rebounds.

Michigan pulled within 40-34 at the half when Nik Stauskas hit a 3-pointer and had chance for a four-point play when McLemore bumped him on the shot. But he missed the free throw.

No matter. In the end, Burke was Fab-u-lous and the Wolverines are one win away from the Final Four.

Alaska Congressman Don Young's use of racial slurs in reference to Latinos prompted a strong backlash from his fellow Republican Party members today as both House and Senate leaders demanded an apology from Young.

Young used the derogatory term "wetbacks" to refer to Latino workers on his father's ranch in an interview Thursday. His comments came only a few weeks after the Republican National Committee released a party "autopsy" report on the presidential election that outlined revitalization strategies, which included prioritizing Hispanic voter outreach.

Sen. John Cornyn of Texas was the first to condemn the congressman's words:

"Migrant workers come to America looking for opportunity and a way to provide a better life for their families. They do not come to this country to hear ethnic slurs and derogatory language from elected officials. The comments used by Rep. Young do nothing to elevate our party, political discourse or the millions who come here looking for economic opportunity," Cornyn said in a statement.

House Speaker John Boehner followed quickly with a statement of his own:

"Congressman Young's remarks were offensive and beneath the dignity of the office he holds. I don't care why he said it - there's no excuse and it warrants an immediate apology."

Representative Joaquin Castro tweeted the following:

Chavez's legacy gains religious glow in Venezuela

CARACAS, Venezuela (AP) ? Holding a Bible in her arms at the start of Holy Week, seamstress Maria Munoz waited patiently to visit the tomb of the man she considers another savior of humanity.

The 64-year-old said she had already turned her humble one-bedroom house into a shrine devoted to the late President Hugo Chavez, complete with busts, photos and coffee mugs bearing his image. Now, she said, her brother-in-law was looking for a larger house to display six boxes' worth of Chavez relics that her family has collected throughout his political career.

"He saved us from so many politicians who came before him," Munoz said as tears welled in her eyes. "He saved us from everything."

Chavez's die-hard followers considered him a living legend on a par with independence-era hero Simon Bolivar well before his March 5 death from cancer. In the mere three weeks since, however, Chavez has ascended to divine status in this deeply Catholic country as the government and Chavistas build a religious mythology around him ahead of April 14 elections to pick a new leader.

Chavez's hand-picked successor, Nicolas Maduro, has led the way, repeatedly calling the late president "the redeemer Christ of the Americas" and describing Chavistas, including himself, as "apostles."

Maduro went even further after Argentine Cardinal Jorge Mario Bergoglio became Pope Francis earlier this month. Maduro said Chavez had advised Jesus Christ in heaven that it was time for a South American pope.

That comes as Maduro's government loops ads on state TV comparing Chavez to sainted heroes such as Bolivar and puts up countless banners around the capital emblazoned with Chavez's image and the message "From his hands sprouts the rain of life."

"President Chavez is in heaven," Maduro told a March 16 rally in the poor Caracas neighborhood of Catia. "I don't have any doubt that if any man who walked this earth did what was needed so that Christ the redeemer would give him a seat at his side, it was our redeemer liberator of the 21st century, the comandante Hugo Chavez."

Chavistas such as Munoz have filled Venezuela with murals, posters and other artwork showing Chavez in holy poses surrounded by crosses, rosary beads and other religious symbolism.

One poster on sale in downtown Caracas depicts Chavez holding a shining gold cross in his hands beside a quote from the Book of Joshua: "Comrade, be not afraid. Neither be dismayed, for I Will be with you each instant." The original scripture says "Lord thy God," and not "I," will accompany humanity each instant.

The late leader had encouraged such treatment as he built an elaborate cult of personality and mythologized his own rise to power, said Carolina Acosta-Alzuru, a University of Georgia media studies scholar who hails from Venezuela.

She said Chavez's successors are clearly hoping that pumping up that mythology can boost Maduro's presidential campaign, which has been based almost entirely on promises to continue Chavez's legacy. The opposition candidate, Gov. Henrique Capriles, counters that Maduro isn't Chavez, and highlights the problems that Chavez left behind such as soaring crime and inflation.

"They're fast-tracking the mythification," Acosta-Alzuru said of the government. "Sometimes I feel that Venezuelan politics has become a big church. Sometimes I feel it has become a big mausoleum."

Teacher Geraldine Escalona said she believed Chavez had served a divine purpose during his 58 years on earth, including launching free housing and education programs and pushing the cause of Latin American unity.

"God used him for this, for unifying our country and Latin America," the 22-year-old said. "I saw him as a kind of God."

Such rhetoric has upset some religious leaders and drawn the reproach of Venezuela's top Roman Catholic official, Cardinal Jorge Urosa Savino, on the eve of the Easter holidays.

"One can't equate any hero or human leader or authority with Jesus Christ," Urosa warned. "We can't equate the supernatural and religious sphere with the natural, earthly and sociopolitical."

Chavez, in his days, crossed paths frequently with Venezuela's church, which sometimes accused the socialist leader of becoming increasingly authoritarian. Chavez described Christ as a socialist, and he strongly criticized Cardinal Urosa, saying he misled the Vatican with warnings that Venezuela was drifting toward dictatorship.

Emerging this week from a church on the outskirts of Caracas, Lizbeth Colmenares slammed politicians from both sides for using derogatory language in the campaign, particularly during Holy Week.

"They are not following the words of Christ," said Colmenares, a 67-year old retiree who was holding palm fronds woven into the shape of the Holy Cross. "They should be more humble and they shouldn't be attacking each other that way."

Of course, politics and religion have long mixed in Latin America, starting with the Spanish conquest of the New World, which Mexican writer Carlos Fuentes famously said was carried out "between sword and cross."

In the 20th century, Argentine first lady Eva Peron helped start a leftist Latin American pantheon after her untimely death in 1952. She's since become a veritable saint for millions in her homeland, with pictures of her angelic face still commonly displayed in homes and government offices. Like Chavez, Peron was worshipped as a protector of the poor as well as a political fighter.

Chavez tied his own legacy to Bolivar, incessantly invoking his name and delivering hundreds of speeches with Bolivar's stern portrait looming over his shoulder. Chavez renamed the whole country "The Bolivarian Republic of Venezuela" and ordered a giant mausoleum built to house Bolivar's bones.

A short animated spot shown repeatedly on state TV this month makes clear that Chavez has already become a political saint for millions. It shows Chavez, after death, walking the western Venezuelan plains of his childhood before coming across Peron, Bolivar, the martyred Chilean President Salvador Allende and Argentine revolutionary Ernesto "Che" Guevara, among others.

"We know that in Argentina we have a Peronism that is very much alive," said Acosta-Alzuru. "And there are other examples in Latin America where a leader, a caudillo, tries to be everything for the country. What Maduro and Chavez's followers are doing is trying to keep Chavez alive."

Some Chavez supporters waiting to visit his tomb on a hill overlooking Caracas said their comandante is with them in spirit ? and for that reason they planned to vote for Maduro, confident that Chavez was guiding his hand.

Reaching the marble tomb means first walking through an exhibit celebrating Chavez's life and military career, with photos and text exalting a seemingly inevitable rise to immortality.

"He's still alive," said 52-year-old nurse Gisela Averdano. "He hasn't died. For me, he will always continue."

(AP) ? For Justin Verlander, $180 million was enough. No need to wait two seasons, become a free agent and find out how much baseball's biggest spenders would offer.

"I wondered what it would be like to test free agency, but the pull of Detroit was too much," the Tigers' ace said Friday after agreeing to a seven-year contract, the richest deal for a pitcher in baseball history. "Once spring training started I knew I wanted to stay."

Verlander's deal broke the record for pitchers set just a month earlier when Seattle's Felix Hernandez agreed to a $175 million, seven-year contract.

"It's a very exciting day," Tigers President Dave Dombrowski said. "It's a big day for us. He's as fine a pitcher as there is in baseball. His record speaks for itself. He can be one of the greatest, if not the greatest pitcher in Tiger history."

The 2011 AL MVP and Cy Young Award winner had been signed through 2014 under an $80 million, five-year contract paying him $20 million in each of the next two seasons.

The new deal keeps those salaries and adds $140 million in guaranteed money: $28 million each season from 2015-19. It includes a $22 million option for 2020 that would become guaranteed if he finishes among the top five in 2019 Cy Young voting. The deal could be worth $202 million over eight seasons.

"The city of Detroit is committed to winning," he said. "I'm so excited to be playing in Detroit. I was never shy about saying I wanted to stay in Detroit. It's tough to put into words how much I love Detroit. We have the best fans in baseball."

Considered an elite pitcher since winning the 2006 AL Rookie of the Year award, the 30-year-old right-hander is 124-65 with a 3.40 ERA in eight major league seasons with two no-hitters. He was 24-5 two years ago, becoming the first starting pitcher to sweep Cy Young and MVP since Boston's Roger Clemens in 1986.

Verlander also has compiled a 19-win season and two each of 18 and 17. He led the big leagues in strikeouts and innings in 2009, 2011 and 2012.

"He is never going to be content," Dombrowski said. "He wants a World Series, and he wants the Hall of Fame."

Verlander's teammates were pleased for their star pitcher.

"First, he deserves it because it means a lot for all of us," pitcher Max Scherzer said. "From now on, every time we go out to dinner, I am not even going to make a token effort to pull out my credit card. Every dinner this year is on him."

UN approves 'targeted offensive operations' against Congo rebels

UNITED NATIONS (Reuters) - The U.N. Security Council on Thursday approved the creation of a unique new combat force that is to carry out "targeted offensive operations" to neutralize armed groups in conflict-torn eastern Democratic Republic of Congo.

The 15-member Security Council unanimously adopted a resolution establishing the so-called intervention brigade - the first time the United Nations has created such a unit within a traditional peacekeeping force - as part of the existing 20,000-strong U.N. force in Congo, the U.N. Stabilization Mission in the Democratic Republic of Congo, known as MONUSCO.

It says MONUSCO will "carry out targeted offensive operations through the Intervention Brigade ... either unilaterally or jointly with the (Congo army), in a robust highly mobile and versatile manner ... to prevent expansion of all armed groups, neutralize these groups, and to disarm them."

The resolution also states that the intervention brigade will be made up of three infantry battalions, one artillery and one special force and reconnaissance company headquartered in Goma under the direct command of the MONUSCO force commander.

Diplomats say South Africa, Tanzania and Malawi are the most likely candidates to supply the troops for the intervention unit. Mozambique had also been tipped to be part of the new unit but it will likely not be part of the new brigade.

Council diplomats say that the African Union has pushing for the establishment of a "peace enforcement" wing of MONUSCO, even though the U.N. peacekeeping department, a number of council members and human rights groups have expressed concerns about how the force will work in reality.

The resolution also says that a Congolese rapid reaction force should be created with the intention of taking over the work of the intervention brigade once it completes its job.

Until now MONUSCO had a traditional peacekeeping mandate to protect civilians and support operations by the Congolese army in Congo - a country the size of Western Europe.

The resolution makes clear that the intervention brigade will be established "on an exceptional basis, and without creating a precedent or any prejudice to the agreed principles of peacekeeping."

CONCERNS

After the vote, Guatemalan Ambassador Gert Rosenthal voiced concerns to the council about the creation of the intervention brigade, saying it should be entirely separate from MONUSCO.

The United States had also previously raised concerns that there was not a clear enough distinction between the job of the intervention brigade and the existing peacekeepers, council diplomats said.

The United Nations has avoided peace enforcement since its involvement in Somalia in the 1990s. That involvement withered after the 1993 "Black Hawk Down" incident in which militia fighters shot down two U.S. military helicopters over Mogadishu.

Separately, the United Nations has given Congo four more days to begin prosecuting soldiers accused of raping scores of women in an eastern town or it will halt support to two battalions.

The United Nations said 126 women were raped in Minova in November after Congolese troops fled to the town as so-called M23 rebels briefly captured the nearby provincial capital of Goma.

The U.N. special envoy to Congo, Roger Meece, informed Congolese authorities in a March 25 letter that they had seven days to take action.

"The letter informed the Congolese Government of the termination of all MONUSCO support to the two battalions involved in the Minova rapes, should no appropriate action be taken immediately, within 7 days," a spokesman for the U.N. department of peacekeeping said.

The United Nations had previously told Congo that it would end support to two battalions linked to the Minova rapes if it did not try the soldiers involved.

U.N. spokesman Martin Nesirky said in December that alleged human rights abuses were committed in and around Minova between November 20 and November 30, including the 126 rapes and the killing of two civilians. Nesirky said at the time that two soldiers were charged with rape, while seven more were charged with looting.

Peacekeepers have been stretched thin by the M23 rebellion in the resource-rich east of Congo. That is why the council created the special intervention force, which one senior council diplomat has said will be able to "search and destroy" the M23 rebels and other armed groups in the country.

M23 began taking parts of eastern Congo early last year, accusing the government of failing to honor a 2009 peace deal. That deal ended a previous rebellion and led to the rebels' integration into the army, but they have since deserted.

M23, which a U.N. expert panel said last year was backed by Rwanda, has struggled with infighting in recent weeks.

Rwanda, which is on the Security Council until the end of 2014, voted for the creation of the intervention force. Rwandan Ambassador Eugene Richard Gasana told the council Kigali was committed to peace in neighboring Congo.

African leaders signed a U.N.-mediated accord late last month aimed at ending two decades of conflict in eastern Congo and paving the way for the creation of the intervention force.

    Estrogen plus progestin use linked with increased breast cancer incidence and mortality

    Mar. 29, 2013 ? Estrogen plus progestin use is linked with increased breast cancer incidence. In addition, prognosis is similar for both users and nonusers of combined hormone therapy, suggesting that mortality from breast cancer may be higher for hormone therapy users as well, according to a study published March 29 in the Journal of the National Cancer Institute.

    In the Women's Health Initiative (WHI) randomized trial, estrogen plus progestin was associated with an increase in both breast cancer incidence and mortality. However, most observational studies have linked estrogen plus progestin with more positive outcomes.

    In order to determine the differences between the WHI trial and other observational studies, Rowan T. Chlebowski, M.D., Ph.D., Los Angeles Biomedical Research Institute (LA BioMed) lead researcher and colleagues, looked at postmenopausal women with no prior hysterectomy with negative mammograms within two years who were either users or non-users of estrogen and progestin combined therapy.

    The researchers found that breast cancer incidence was higher in estrogen plus progestin users than incidence in nonusers. Women who started hormone therapy closer to menopause had a higher breast cancer risk with a weakening influence as the time from menopause increased.

    "Because survival after breast cancer diagnosis did not differ between estrogen plus progestin users and nonusers, the higher breast cancer incidence of those using estrogen plus progestin may lead to increased breast cancer mortality on a population basis," the authors write.

    In an accompanying editorial, Catherine Schairer, Ph.D., and Louise A. Brinton, Ph.D., both of the National Cancer Institute, write that questions remain about whether the data analyzed from the WHI observational study resolves the differences in tumor prognosis and tumor characteristics when compared to the WHI randomized trial. They write that, "In general, tumors in estrogen plus progestin users in the WHI Observational Study were not significantly different from those in non-hormone users with regard to number of positive lymph nodes or tumor size, but were more likely to be well differentiated and positive for hormone receptors, findings which are similar to other observational studies." This, however, did not translate into a survival benefit. They recommend further analyses in this and other datasets of currency and duration of hormone use in relationship to tumor development to fully resolve the issue of tumor characteristics associated with estrogen plus progestin therapy.

    Asia stocks modestly higher after S&P hits record

    BANGKOK (AP) ? Asian stock markets were mostly higher Friday as momentum carried over from yet another record high on Wall Street.

    The Standard and Poor's 500 index closed at its highest level ever Thursday, driven by more encouraging data on the U.S. economic recovery. The government said the economy grew at an annual rate of 0.4 percent in the October-December quarter, slightly better than previous estimates. The revision reflected stronger business investment and export sales.

    South Korea's Kospi rose 0.8 percent to 2,010.40. Taiwan's TAIEX advanced 0.7 percent to 7,920.38. Markets in Hong Kong, India, Australia, New Zealand, Indonesia, Philippines and Singapore were shut for Good Friday.

    Japan's Nikkei reversed early losses to rise 0.4 percent at 12,389.16. Gains were muted, however, as the yen leveled off against the dollar and the government released figures for February showing the country's jobless rate edging up while industrial production fell slightly.

    Newly appointed central bank governor, Haruhiko Kuroda, has pledged to work with the government to end decades of growth-inhibiting deflation. His outspoken calls for action have raised hopes for results but some analysts said they may also have created unrealistic expectations for a turnaround.

    "Unfortunately, the markets' expectations of the new Governor are so high that they will be almost impossible to meet, let alone beat," said analysts at Capital Economics in a market commentary.

    Shares in mainland China fell amid limited trading volume, analysts said. The Shanghai Composite Index was 0.1 percent lower at 2,233.23 and the Shenzhen Composite Index fell 0.3 percent to 927.06.

    Peng Yunliang, a Shanghai-based analyst, said shares in brokerage houses declined following the release Thursday of official policies aimed at tightening control over wealth management products.

    In Europe on Thursday, markets responded positively to the calm reopening of Cyprus's banks. Banks in the Mediterranean island nation were shut for nearly two weeks as the government negotiated a rescue loan from international lenders to prevent the financial system from collapsing. The FTSE 100 index of leading British shares, Germany's DAX and France's CAC-40 all closed higher Thursday.

    Italy's political uncertainty will also remain in the spotlight. Following inconclusive elections around a month ago, the country is still without a government, and that's raised concerns over its future economic path. Italy is the third-largest economy of the 17 countries that use the euro.

    The Standard and Poor's 500 index closed at a record Thursday, surpassing its previous record close of 1,565.15 set in October 2007. The Dow, which surpassed its previous all-time high at the start of the month, also rose.

    The Dow Jones industrial average gained 0.4 percent to close at 14,578.54. The S&P 500 advanced 0.4 percent to close at 1,569.19. The Nasdaq composite index added 0.3 percent to 3,267.52. U.S. stock markets will be shut for the Good Friday holiday. Thursday was the last trading day of the first quarter.

    The New York Mercantile Exchange, where benchmark oil is traded, was closed for the Good Friday holiday.

    In currencies, the euro rose to $1.2826 from $1.2822 late Thursday in New York. The dollar fell to 94.07 yen from 94.13 yen.

    Man accused of using fake penis for drug test

    ST. CHARLES, Mo. (AP) ? A man accused of using a prosthetic penis to try to pass a drug test is now facing charges in eastern Missouri.

    Authorities allege that 34-year-old Sydney Levin was submitting a urine sample last week as part of his probation when an officer allegedly spotted him using a prosthetic known as a Whizzinator. The prosthetic is advertised as a discreet device that includes synthetic "medical grade urine."

    Levin, of Lake St. Louis, was charged last week with possessing a forging instrument, KMOV-TV (http://bit.ly/11SXafU ) reported. He was arrested and released after posting $25,000 bond, and pleaded not guilty on Monday.

    Levin was on probation for possession of a controlled substance and felony stealing in 2009. Authorities said Levin's probation required that he submit a urine sample as part of drug test.

    Levin did not have a listed phone number. Court records show that he does not yet have an attorney.

    In 2010, Gerald Willis of Los Angeles was sentenced to six months in federal prison for running a company that sold the Whizzinator to cheat on drug tests. Willis' company disbanded, but the Whizzinator is still sold online as a sex toy. A message seeking comment Thursday from the company selling the device was not returned.

    Obama to pitch investing in public works in Miami

    WASHINGTON (AP) ? President Barack Obama will press Congress to pass new tax incentives and other flexibility measures aimed at attracting more private sector investment in infrastructure projects around the country, a senior administration official said.

    The president will flesh out the details of his proposals during a speech Friday at a Miami port that is undergoing $2 billion in upgrades, funded by public and private money. In his quick trip to South Florida, Obama will try to show the public that the economy remains his top priority in the midst of high-profile campaigns on immigration reform and gun control.

    Among the proposals Obama will call for Friday:

    ? Higher caps on "private activity bonds" to encourage the private sector to spend more on highway projects and other infrastructure needs. State and local governments use the bonds to attract investment.

    ? Giving foreign pension funds tax-exempt status when selling U.S. infrastructure, property or real estate assets. U.S. pension funds are generally tax exempt under such circumstances. The administration says some international pension funds cite the tax burden as a reason for not investing in American infrastructure.

    ? $4 billion in new spending on two infrastructure programs that award loans and grants.

    ? A renewed call for a $10 billion national "infrastructure bank" ? a proposal from his first term that gained little traction.

    The administration official requested anonymity because the proposals were not being announced publicly until Friday's event.

    The president made private sector infrastructure investment a key part of the economic agenda he rolled out in his State of the Union address last month. He also called in the national address for a "Fix-It-First" program that would spend $40 billion in taxpayer funds on urgent repairs.

    Obama's focus on generating more private sector investment underscores the tough road new spending faces on Capitol Hill, where Republican lawmakers often threaten to block additional spending unless it is offset through tax cuts or other measures.

    The official said any increased spending associated with the proposals Obama was outlining Friday would not add to the deficit. But the official did not detail how the costs would be offset, saying only that more information would be included in the president's budget.

    Obama will release his budget April 10.

    Restaurant operators remain generally optimistic about sales growth and the economy in the months ahead

    Restaurant Performance Index Fell Below 100 in February as Sales and Traffic Levels DeclinedWashington, DC? (RestaurantNews.com)? Due in large part to softer same-store sales and customer traffic levels, the National Restaurant Association?s Restaurant Performance Index (RPI) slipped below 100 in February. The RPI ? a monthly composite index that tracks the health of and outlook for the U.S. restaurant industry ? stood at 99.9 in February, down 0.8 percent from January?s five-month high. February represented the fourth time in the last five months that the RPI stood below 100, which signifies contraction in the index of key industry indicators.

    ?The Restaurant Performance Index decline was due largely to softer sales and traffic results, which fell in February amid higher gas prices and the impact of the payroll tax hike,? said Hudson Riehle, senior vice president of the Research and Knowledge Group for the Association. ?In addition, sales and traffic comparisons were more difficult due to the extra day in February 2012 as a result of Leap Year.?

    ?Despite the sales and traffic declines in February, restaurant operators remain generally optimistic about business conditions in the months ahead, which suggests they feel the setbacks will be temporary,? Riehle added.

    The RPI is constructed so that the health of the restaurant industry is measured in relation to a steady-state level of 100. Index values above 100 indicate that key industry indicators are in a period of expansion, while index values below 100 represent a period of contraction for key industry indicators. The Index consists of two components ? the Current Situation Index and the Expectations Index.

    The Current Situation Index, which measures current trends in four industry indicators (same-store sales, traffic, labor and capital expenditures), stood at 98.3 in February ? down 1.4 percent from January?s level. In addition, the Current Situation Index stood below 100 for the 6th consecutive month, which signifies contraction in the current situation indicators.

    With sales comparisons more difficult in February due to Leap Year in 2012, restaurant operators reported a same-store sales decline for the first time in 21 months. Thirty-three percent of restaurant operators reported a same-store sales gain between February 2012 and February 2013, while 48 percent of operators reported lower sales. In January, 44 percent of operators reported higher same-store sales, while 37 percent reported a sales decline.

    Restaurant operators also reported a decline in customer traffic levels in February. Twenty-four percent of restaurant operators reported higher customer traffic levels between February 2012 and February 2013, while 53 percent of operators said their traffic declined. In January, 33 percent of operators reported an increase in customer traffic, while 40 percent reported lower traffic levels.

    Capital spending activity also dipped along with the sales and traffic results. Forty-eight percent of operators said they made a capital expenditure for equipment, expansion or remodeling during the last three months, down from 52 percent who reported similarly last month.

    The Expectations Index, which measures restaurant operators? six-month outlook for four industry indicators (same-store sales, employees, capital expenditures and business conditions), stood at 101.4 in February ? down slightly from January?s level of 101.6. Each of the four expectations indicators stood above 100 for the second consecutive month, which suggests restaurant operators remain generally optimistic about business conditions in the months ahead.

    Although restaurant operators? outlook for sales growth remains positive, their expectations are slightly less bullish compared to last month. Forty-one percent of restaurant operators expect to have higher sales in six months (compared to the same period in the previous year), down from 46 percent last month. Meanwhile, 14 percent of restaurant operators expect their sales volume in six months to be lower than it was during the same period in the previous year, compared to 17 percent last month.

    Although restaurant operators have a net positive outlook for the overall economy for the second consecutive month, their confidence is tenuous. Twenty-five percent of restaurant operators said they expect economic conditions to improve in six months, down from 30 percent who reported similarly last month. Meanwhile, 20 percent of operators said they expect economic conditions to worsen in the next six months, unchanged from last month.

    Restaurant operators continue to make plans for capital spending in the months ahead. Fifty-seven percent of restaurant operators plan to make a capital expenditure for equipment, expansion or remodeling in the next six months, down slightly from 59 percent who reported similarly last month.

    The RPI is based on the responses to the National Restaurant Association?s Restaurant Industry Tracking Survey, which is fielded monthly among restaurant operators nationwide on a variety of indicators including sales, traffic, labor and capital expenditures.     Adlynn and Robert Harte sued this week to get more information about why sheriff's deputies searched their home in the upscale Kansas City suburb of Leawood last April 20 as part of Operation Constant Gardener ? a sweep conducted by agencies in Kansas and Missouri that netted marijuana plants, processed marijuana, guns, growing paraphernalia and cash from several other locations.

    April 20 long has been used by marijuana enthusiasts to celebrate the illegal drug and more recently by law enforcement for raids and crackdowns. But the Hartes' attorney, Cheryl Pilate, said she suspects the couple's 1,825-square-foot split level was targeted because they had bought hydroponic equipment to grow a small number of tomatoes and squash plants in their basement.

    "With little or no other evidence of any illegal activity, law enforcement officers make the assumption that shoppers at the store are potential marijuana growers, even though the stores are most commonly frequented by backyard gardeners who grow organically or start seedlings indoors," the couple's lawsuit says.

    The couple filed the suit this week under the Kansas Open Records Act after Johnson County and Leawood denied their initial records requests, with Leawood saying it had no relevant records. The Hartes say the public has an interest in knowing whether the sheriff's department's participation in the raids was "based on a well-founded belief of marijuana use and cultivation at the targeted addresses, or whether the raids primarily served a publicity purpose."

    "If this can happen to us and we are educated and have reasonable resources, how does somebody who maybe hasn't led a perfect life supposed to be free in this country?" Adlynn Harte said in an interview Friday.

    The suit filed in Johnson County District Court said the couple and their two children ? a 7-year-old daughter and 13-year-old son ? were "shocked and frightened" when deputies armed with assault rifles and wearing bulletproof vests pounded on the door of their home around 7:30 a.m. last April 20.

    "It was just like on the cops TV shows," Robert Harte told The Associated Press. "It was like 'Zero Dark Thirty' ready to storm the compound."

    During the sweep, the court filing said, the Hartes were told they had been under surveillance for months, but the couple "know of no basis for conducting such surveillance nor do they believe such surveillance would have produced any facts supporting the issuance of a search warrant."

    Harte said he built the hydroponic garden with his son a couple of years ago. He said they didn't use the powerful light bulbs that are sometimes used to grow marijuana and that the family's electricity usage didn't change dramatically. Changes in utility usage can sometimes lead authorities to such operations.

    When law enforcement arrived, the family had just six plants ? three tomato plants, one melon plant and two butternut squash plants ? growing in the basement, Harte said.

    The suit also said deputies "made rude comments" and implied their son was using marijuana. A drug-sniffing dog was brought in to help, but deputies ultimately left after providing a receipt stating, "No items taken."

    Pilate said no one in the Harte family uses illegal drugs and no charges were filed. The lawsuit noted Adlynn Harte, who works for a financial planning firm, and Robert Harte, who cares for the couple's children, each were required to pass rigorous background checks for their previous jobs working for the CIA in Washington, D.C. Pilate said she couldn't provide any other details about their CIA employment.

    Pilate said any details gleaned from the open records suit could be used in a future federal civil rights lawsuit.

    "You can't go into people's homes and conduct searches without probable cause," Pilate said.

    Leawood City Administrator Scott Lambers said Friday that he couldn't comment on pending litigation. The sheriff's office also had no comment.

    "Obviously with an ongoing lawsuit we are not able to talk about any details of it until it's been played out in court," said Johnson County Deputy Tom Erickson.
